Emobi Web Application Terms of Use
About the Emobi Web App
The Emobi Web App (hereinafter referred to as “this Web Application”) is a web application related to Emobi, a members-only electric vehicle sharing service provided by eMoBi Inc. (hereinafter referred to as “the Company”). The Company establishes the following terms of use for this Web Application (hereinafter referred to as “these Terms”). Users of this Web Application (hereinafter referred to as “the User”) must agree to and comply with these Terms. Furthermore, the User shall use this Web Application at their own risk after understanding the contents of these Terms.
Intellectual Property Rights, etc.
All intellectual property rights and any other rights related to this Web Application belong to the Company or a third party that has granted a license to the Company.
Prohibited Matters
The use of this Web Application by the User is restricted to personal use only. Any commercial use, use for political or religious activities, use for any other purpose not approved by the Company, and any secondary use are strictly prohibited.
The following actions by the User concerning the contents of this Web Application (including its software) are strictly prohibited:
- Reproduction, distribution, public transmission, modification, adaptation, translation, or creation of any other secondary works.
- Transfer, sale, assignment, or any other disposal to a third party, as well as sublicensing, lending, etc.
- Reverse engineering, decompiling, disassembling, or any other analysis.
- Any other act that the Company deems inappropriate based on reasonable grounds.
The following acts are strictly prohibited through this Web Application:
- Acts that infringe or may infringe upon the rights of the Company or a third party.
- Acts that slander or defame the Company or a third party, or damage their reputation, or acts that may do so.
- Providing false information to this Web Application.
- Acts that interfere with the operation of the service or may otherwise hinder the provision of this Web Application.
- Any other acts that violate or may violate laws, regulations, or public order and morals.
The use of this Web Application by members or affiliates of organized crime groups (boryokudan), related entities, or other antisocial organizations is strictly prohibited.
If the User commits any act that falls under the prohibited matters in these Terms, the Company shall be entitled to suspend the User’s use of this Web Application.
No Guarantees
The Company does not guarantee the accuracy, soundness, applicability, usefulness, operational integrity, compatibility with the User’s equipment, or any other matter concerning this Web Application. The User acknowledges and agrees in advance to use this Web Application with the understanding that it may become unavailable due to unavoidable circumstances such as communication failures, defects or failures of system equipment, or other disruptions.
Disclaimer of Liability
The Company shall not be liable for any damages incurred by the User in cases where the Company is unable to provide the services within this Web Application (hereinafter referred to as “the Services”) due to force majeure events not attributable to the Company, such as natural disasters, communication failures in the telecommunications business, or failures or malfunctions of the systems used to operate this Web Application.
The Company shall not be held responsible in any way if information being entered by the User is lost within this Web Application.
Damages
Notwithstanding any other provisions of these Terms, if the User incurs damages due to reasons attributable to the Company, the scope of the Company’s liability shall be limited to direct and ordinary damages actually incurred by the User, and the maximum amount shall be the usage fee of the contract established between the User and the Company through this Web Application, except in cases of willful misconduct or gross negligence by the Company.
Changes, Interruption, and Termination of this Web Application
The Company may, without prior notice to the User and for any reason, change the content, display, operation methods, or any other operational aspect of this Web Application, or interrupt or terminate the provision of this Web Application.
Changes to These Terms, etc.
The Company may change these Terms without the prior consent of the User by posting the changes on this Web Application or by notifying the User in a manner deemed appropriate in light of the nature of such changes. In such cases, the changes shall become effective from the effective date specified in the aforementioned notification.
Handling of Personal Information
The handling of personal information collected from the User by the Company shall be in accordance with the “Privacy Policy” separately established by the Company.
Translation
These Terms are prepared in Japanese, and the Japanese version shall be the official text. Any translations into other languages are for reference purposes only. If there is any discrepancy between the versions, the interpretation of the Japanese version shall prevail.
Addendum
Effective as of June 13, 2025
