Emobi Privacy Policy

eMoBi Inc. (hereinafter referred to as “the Company”) handles the personal information of customers of our services (including those who intend to use our services; the same shall apply hereinafter) in accordance with this “Privacy Policy” (hereinafter referred to as “this Policy”).

For the protection of personal information, the Company complies with the Act on the Protection of Personal Information (hereinafter referred to as the “APPI”), guidelines from relevant ministries and agencies applicable to the Company, and other related laws and regulations (hereinafter collectively referred to as “Laws and Regulations”).

This Policy applies to the use of the electric vehicle sharing service and other services operated by the Company (hereinafter collectively referred to as “the Services”).

Definition of Personal Information

Personal information refers to “personal information” as defined by the APPI, and includes, but is not limited to, the following information:

  • Address, name, telephone number, date of birth, age, gender, email address, driver’s license information, credit card information, information separately requested by the Company for identity verification, and other information that can identify a specific individual (including information that can be easily collated with other information, thereby identifying a specific individual).
  • Videos and images recorded by the drive recorder installed in the electric vehicle.

About Usage Information

Usage information refers to any information related to the use of the Services (excluding that which falls under personal information), and includes, but is not limited to, the following information:

  • Information regarding the content, date and time, and frequency of the Services used, as well as information on usage history and status, such as actions taken during the use of the Services (this includes information on the type of mobile phone/smartphone used, IP address, browser language, browser type, access logs, and other usage-related information).
  • Photos, comments, and other information posted when using the Services.
  • Information regarding the payment status related to the Services.
  • Location information recorded by the GPS installed in the electric vehicle and the application necessary for its use.
  • Videos and images recorded by the drive recorder installed in the electric vehicle.

Acquisition of Customer Information

The Company acquires personal information and usage information (hereinafter collectively referred to as “Customer Information”) through the following methods. The Company shall acquire Customer Information by appropriate means, not by deceit or other wrongful means, in accordance with Laws and Regulations.

  • Having the customer input Customer Information on the Services (including on paper, websites, and applications).
  • Having the customer provide Customer Information to the Company via email, mail, in writing, by telephone, or by electromagnetic means (including the submission of image data using functions of the application provided by the Company, and the provision of information by reading IC chips, etc.).
  • We may acquire usage history, etc., when you use or browse the Services.
  • The use of the drive recorder and GPS installed in the electric vehicle is automatically incidental to the use of the Services.

Management of Customer Information

Persons engaged in the management and use of Customer Information at the Company shall strictly manage such information and shall perform their duties with sufficient care in handling Customer Information to prevent unauthorized access, loss, leakage, alteration, etc.

Purpose of Use of Customer Information

The Company will use Customer Information within the scope of the purposes of use separately notified at the time of acquisition or for the following purposes:

  • To provide the Services (including for purposes such as the use of electric vehicles, tracking the location of vehicle bodies, and implementing measures on the service).
  • To verify the identity and review the eligibility of the customer, the renter, and the driver at the time of member registration and vehicle rental.
  • As a business operator licensed under Article 80, Paragraph 1 of the Road Transport Act, to fulfill obligations required as a condition of the business license, such as creating a rental certificate at the time of concluding a rental agreement.
  • To communicate and provide information on various matters related to the Services.
  • To bill for, receive payment for, and confirm payments for the Services.
  • To collect claims (including compensation and advances for traffic violation fines, etc.) that the Company has against the customer.
  • To investigate and analyze the usage status of the Services.
  • To improve and enhance the content of the Services for greater customer satisfaction, or to develop new services.
  • To survey satisfaction with the Services.
  • For marketing purposes, such as sending information and announcements about the Services, new services, and other various services (including displaying advertisements optimized for customers of the service).
  • To send information and announcements about the Services, new services, services of partner companies, and other various services.
  • To resolve operational troubles of the Services.
  • To investigate the cause of accidents related to the Services and for post-accident processing.
  • To prevent fraudulent activities that interfere with the normal operation of the Services.
  • For Customer Information related to business offices, for purposes concerning the establishment and use of the office, payments, and other aspects of providing the Services.
  • For use in research (including research on the Services, new services, and services provided by third parties conducting joint research with the Company).
  • To provide to third parties in connection with the above purposes of use or for purposes for which the individual’s consent has been separately obtained (however, provision to third parties shall be as stipulated below).

Provision of Personal Information to Third Parties

The Company may provide Customer Information to third parties in the following cases, within the scope permitted by Laws and Regulations:

  • When cooperating with a national agency, a local government, or a person entrusted by them in executing affairs prescribed by law (including the execution of joint projects with a national agency or local government, or the execution of projects commissioned by a national agency or local government).
  • When providing to universities or research institutions for joint research.
  • In the event of an accident related to the Services, when necessary for the application of automobile insurance, etc.
  • For the purpose of safety measures for accidents related to the use of the Services, when providing to insurance companies, external research institutions, or other third parties engaged in safety measure initiatives with the Company to consider recurrence prevention measures and other safety measures.
  • When the Company entrusts the collection of claims (including compensation and advances for traffic violation fines, etc.) it has against the customer to a third party.
  • When the Company engages in marketing, business development, etc., in partnership with a third party, and provides information to said partner for the purpose of jointly conducting marketing, business development, etc. (including provision for the purpose of delivering advertisements for products and services provided by the partner).
  • When providing information to the extent necessary to report on the status of the Company’s business to parties related to the Company’s business (including owners and managers of business offices) and to the Company’s shareholders and other funders.
  • When the business including personal information is succeeded due to a merger, company split, business transfer, or other reasons.
  • When the Company entrusts all or part of the handling of personal information within the scope necessary to achieve the purpose of use.
  • In other cases where the provision of personal information to a third party is permitted by law.

Use of “Logs,” etc.

The Company acquires information that is automatically generated when a customer uses the Services, such as IP address, browser type, and browser language.

This information is used to analyze the customer’s user environment, to provide better services, and to prevent fraudulent activities that interfere with the normal provision of services.

Use of “Device Information,” etc.

The Company may acquire device information such as the unique identifier of the terminal used by the customer.
This information is used to provide better services and to prevent fraudulent activities that interfere with the normal provision of services.

Use of “Cookies,” etc.

The Services use cookies, web beacons, terminal identifiers, and SDKs (hereinafter collectively referred to as “Cookies, etc.”). The Company can acquire access information, browsing information, etc., of customers who have used the Services (including those who intend to use the Services) through Cookies, etc., and this information is used or transmitted to improve the convenience of the Services and to display advertisements suitable for the customer. Information acquired through Cookies, etc. (hereinafter referred to as “Cookie Information”) does not include information that can identify and specify the customer on its own.

If a customer does not wish to permit the use of Cookies, etc. on the Services, please disable Cookies, etc. in your browser settings. Please note that if Cookies, etc. are disabled, the convenience of the Services may be impaired, or the scope of services provided by the Services may be limited.

About “Pseudonymously Processed Information”

The Company may process personal information into pseudonymously processed information (referring to “pseudonymously processed information” as defined by the APPI; the same shall apply hereinafter) that cannot identify the individual customer, and may use this information.

During the provision period of the Services, when creating pseudonymously processed information based on a customer’s personal information, the Company will create it by deleting data items that could identify the individual or by replacing them with random character strings, thereby generalizing the information.

The Company will handle pseudonymously processed information appropriately within the scope of the purposes of use of Customer Information described in this Policy.

Correction of Personal Information by the Company

If there are changes to personal information that may hinder the use of the Services or billing, such as the names of municipalities, postal codes, names of financial institutions, or credit card expiration dates, the Company may change the registered personal information.

Security Measures for Personal Information

The Company securely stores acquired Customer Information on servers in an environment inaccessible to general internet users and strives to prevent unauthorized access, loss, destruction, alteration, or leakage.

Disclaimer and Notes

The Company shall not be liable for any damage incurred by the customer without negligence on the part of the Company regarding Customer Information.
Please manage your own information strictly to prevent it from being lost, forgotten, or known to third parties.

Changes to this Policy and Confirmation of the Latest Policy

The Company will endeavor to improve this Policy as appropriate and may change this Policy from time to time as necessary. If changes are made to matters in this Policy that legally require the consent of the individual, the revised Policy will apply to customers who have given their consent.

Language

This Policy is prepared in Japanese, and has been translated into English and Chinese. The Japanese version is the official text, and the English and Chinese versions are for reference purposes. In the event of any conflict or inconsistency among these language versions, the order of precedence shall be Japanese, followed by English, and then Chinese.
